Our Privacy Commitment

At Studiosity Pty Limited (“Studiosity”; also referred to as “we”, “us” and similar terms throughout this Policy), we believe that you should understand the way in which we collect, use, disclose and protect your personal information. For the purposes of this Policy, “personal information” means any identifiable information about an individual, including but not limited to an individual’s name, home address, telephone number, social insurance number, gender, income and family status, except any other information otherwise exempted by the applicable laws of Canada. This policy is intended to explain clearly and in plain language some of the key processes and procedures that we have implemented to manage personal information, to protect the privacy of individuals and to comply with the applicable privacy laws in Canada.

What Personal Information Do We Collect?

The personal information we collect may depend upon the type of Studiosity user you are:

  • Student – a user of our services (“Services”);
  • Student Mentor – a user and provider of our Services;
  • Subject Specialist – a provider of our Services;
  • Partner Representative – an administrator, teacher or similar representative from an organization who contracts for our Services; and/or
  • General Contact – an individual interested in learning more about our services.

Most of the personal information that we collect will be via our website, located at https://studiosity.com/.

The type of personal information we collect from Students may include:

  • your name;
  • your contact information, including email addresses, phone number;
  • your year of study; and
  • your education status, including entity/institution name;

We may collect the following additional information from Student Mentors:

  • financial information and banking information;
  • degree information, including individual units of study and results;
  • identity verification documentation such as a passport, birth certificate or drivers licence; and
  • your Social Insurance Number;

We may collect the following additional information from Subject Specialists:

  • financial information and banking information;
  • degree information, including individual units of study and results;
  • identity verification documentation such as a passport, birth certificate or drivers licence; and
  • your Social Insurance Number;

For Partner Representatives, we will collect your name and contact information, including your email address, phone number and your role within your institution.

For General Contacts, we will usually collect your name, email address, the type of Service you are interested in and the country you live in. General Contacts may choose to provide any other information that they consider relevant in learning about our Services. We encourage you to not provide sensitive information such as medical or financial information unless necessary.

Why Do We Collect Personal Information?

The main reason that we collect your personal information is to provide our Services.

Our Services relate to the provision of individualised, one-to-one educational support to students and families in circumstances where Students are either our direct consumer clients or are the end users of our commercial clients (i.e., schools, tertiary institutions, other educational institutions, libraries and corporations).

For Students, our Services will include assisting with homework, study, assignment research, revision and exam preparation. To do so, we match Students with Student Mentors and Subject Specialists for discussion, feedback and responses in respect of study queries and other aspects of study. Our Services are delivered through the Internet.

Student Mentors and Subject Specialists will assist in providing and facilitating our Services to Students. They provide guidance based on specific queries around areas of study or general feedback on academic work that students have engaged in.

We use information only for the purposes for which we collected it, including:

  • to consider a request for our Services;
  • to coordinate the setup and activation of our Services;
  • to facilitate, process and respond to the educational or study queries of Students, Student Mentors and Subject Specialists;
  • to facilitate online chats between Students and Student Mentors and/or Subject Specialists;
  • to understand the progress of, and Services required by, Students;
  • to facilitate Student Mentor and Subject Specialist training;
  • to facilitate and process payments for our Services;
  • to assist us in providing and improving our Services (including analysing usage of our Services and industry trends and developing, improving and marketing our Services);
  • for regulatory reporting and compliance with our legal obligations;
  • to ensure the safety of individuals (e.g., if we believe the personal safety of a Student or any other person is at risk and it is a reasonable action to take to protect that Student or any other person from possible injury);
  • to perform administrative and operational tasks;
  • marketing our Services to all User types to show how our Services can help them;
  • to seek feedback in relation to partner satisfaction; and
  • to consider any concerns or complaints made against us.

There is no obligation to provide personal information for use by us but if you do not provide us with the personal information that we require, we may not be able to provide the Services that you require.

How do we collect personal information?

The means by which we collect personal information may depend on the Services we are providing, and whether you are a Student, Student Mentor, Subject Specialist, Partner Representative or General Contact.

For example, we may collect personal information:

  • directly from Students, Student Mentors, Subject Specialists, Partner Representatives or General Contacts;
  • indirectly, when Students, Student Mentors or Partner Representatives access the Services via a third-party software platform from our commercial clients who have obtained the express consent of the individual Student (collectively, “Partners”), Student Mentor or Partner Representative to disclose their personal information to us for its relevant use; or
  • from publicly available sources (e.g., from Partner websites);

We will collect personal information directly from the relevant individual where ever possible.

Studiosity has contractual measures in place to ensure that proper consent has been collected from Partners prior to personal information being transferred to Studiosity.

Cookies

Personal information will not be collected where a person is only browsing our website, but we do use cookies to improve our Services. A cookie is a small file sent to your browser from a web server to be stored on your computer. Cookies are used to enhance interaction and convenience in using our website and we do not use cookies to record any personal information. Cookies do not allow access to your computer or any data / files contained in your computer. We use a variety of different types of cookies on our website. Some of the purposes of different cookies we use are described as follows:

  • Some cookies are essential to the Site in order to enable our log-in process and let you to move around it and to use its features. Without these cookies, we may not be able to provide certain services or features, and our website will not perform as smoothly for you as we would like.
  • We may use cookies to receive and record information about your computer, device and browser, including your IP address, browser type and other software or hardware information. If you access our website from a mobile or other device, we may collect a unique device identifier assigned to that device (“UDID”), geo-location data or other transactional information for that device.
  • We may use analytics cookies to collect information about your use of the Service and enable us to improve the way it works. Analytics cookies collect information about how you use our website; for instance, which pages you go to most. The information allows us to see the overall patterns of usage on our website and help us record any difficulties you have with the website.
  • Social plug-in tracking cookies can be used to track both members and non-members of social networks for additional purposes, such as behavioural advertising, analytics and market research.

Information derived from these cookies may be combined with other information you provide when signing up to use any element of our Services including, but not limited to, filling out a general inquiry on our website. We do this only for the purpose of analysing data in order to improve the Website services.

Is Personal Information Shared or Disclosed?

Yes, we share personal information with certain third parties, as outlined below.

1. Student reports to Partners

Studiosity will share personal information regarding the usage of its services by its Students, Student Mentors and Subject with its commercial clients by way of periodic usage reports. Where commercial clients (e.g., universities, schools) have purchased a licence to use our Services, those commercial clients will have access to, and knowledge of the usage patterns of their students. Such usage patterns will include the content of student learning sessions and any comments left in post-session surveys. We may also share transcripts and audio recordings with our commercial clients for the purpose of quality control of our services. Other information, as noted above, about the Student, Student Mentor or Subject Specialist is also shared in order to provide for analysis on the effectiveness of the Service.

2. Third party service providers

We may share your personal information with other companies that are necessary in the provision of the Services.

We deal with third party service providers who may assist us with a variety of functions including with marketing, research, mail and delivery, security, insurance, professional advisory (including legal, accounting and auditing advice), banking, payment processing, credit reporting or technology services. Where we engage third party service providers to perform services for us, those third parties may be required to handle personal information. Under these circumstances, those third parties must safeguard this information and must only use it for the purposes for which it was supplied and we will make all reasonable enquiries to try to ensure that this is the case.

We will limit personal information provided to independent third parties to that information required for those third parties to properly perform their functions. Further, our contracts with these third parties include provisions for the protection of personal information at or exceeding the standards identified in this Policy.

Third party service providers we use are located in other countries including Australia, United States, United Kingdom and countries of the European Union.

How Do We Protect Personal Information?

We protect personal information using physical, technological and organisational safeguards (collectively, the “Safeguards”). We regularly review our practices to ensure they align with reasonable industry practices appropriate to the level of sensitivity to safeguard personal information against loss or theft, unauthorized access, alteration or disclosure.

Despite using the Safeguards outlined above, “perfect security” does not exist, particularly online. We cannot guarantee the security of information posted or transmitted via our website or online. It is possible that third parties may unlawfully intercept or access such information. If you think someone is impersonating Studiosity, that there has been a breach of your privacy, or you believe that you are the victim of fraud, please contact us as soon as possible.

How Do We Obtain Consent to Collect, Use and Disclose Personal Information?

When you choose to provide us with your personal information, you are consenting to our collection, use and disclosure of your personal information in accordance with this Policy. We may seek additional consent where required by law or in situations where we consider further consent to be necessary or appropriate.

Further consent will be sought from Students and Student Mentors after they first access Studiosity to confirm that Studiosity is permitted to handle their personal information. This will be gained by an explicit agreement to this Privacy Policy.

You are free to refuse or withdraw your consent to the collection, use or disclosure of your personal information by Studiosity at any time upon reasonable notice in writing to Studiosity, subject to certain restrictions as may be permitted by applicable laws.

How Do We Retain Personal Information?

We generally keep personal information for only as long as it is needed to accomplish the purposes for which it was collected, or as needed for authorized or legitimate purposes. More specifically, we retain personal information as long as necessary for the fulfillment of the identified purposes for its collection or as otherwise necessary to comply with applicable laws or protect our interests. When personal information is no longer necessary or relevant for the identified purposes (in general this is 15 months after the last access of the service by an individual), or is required to be retained by applicable laws, Studiosity will take steps to have it deleted, destroyed, erased, aggregated or made anonymous. Studiosity uses reasonable industry practices to ensure we have adequate controls, schedules and practices for information and records retention and destruction which apply to your personal information.

How Do We Maintain Accuracy and Allow Individual Access to Personal Information?

You may request access to and review of your personal information in the possession of Studiosity. However, access may be declined where permitted or required by applicable law, which may include (without limitation) the following circumstances:

  • the information is protected by solicitor-client privilege;
  • disclosure of the personal information would compromise the confidentiality of another individual or threaten the safety of another person; or
  • non-disclosure of the personal information is required or permitted by law.

You may request that we change or delete your personal information in the possession of Studiosity. Note that deletion requests are subject to certain limitations, for example, we may retain personal information as permitted by law, such as for record-keeping purposes, to maintain an active account and to process transactions and facilitate customer requests. If we do not agree that personal information is inaccurate or outdated, we will still maintain a record of any alternative text that the individual concerned believes appropriate.

Where a request for access, alteration, or deletion of personal information is declined, we will provide reasons for declining the request.

This Privacy Policy was last updated in January 2021. We will occasionally update this Policy and revise the “last updated” date appearing in this paragraph.

We will generally notify you of material changes to the Policy, where we are able to do so, which involve new or revised uses or disclosure of personal information that may not be reasonably expected by you at the time that your register for our Services. However, we encourage you to review our Policy from time-to-time, in order to check for updates and refresh your understanding of our personal information handling policies and practices.
